IMS4.2.3.3 Legal and Other Requirements Procedure

1.0   PURPOSE

To ensure that The Company has a procedure to meet the requirements of identifying, conducting and reviewing legislative legal and other requirements .

2.0   SCOPE

This procedure sets out operational steps to conduct a review of the legal and other requirements. This procedure applies to all process in the company that fall under or refer to legislative or other instruments.

5.0   REQUIREMENTS

5.1   Document Identification

Identification of Legal and Other Requirements will be undertaken via the following method

  • Review company scope of work
  • Use scope of work to search Australian legislative websites (see references) and Identify legislative instruments relevant to the company

All external documents controlled by this procedure are identified by their original titles, numbers, issues, etc.

External documents are to handled in accordance with IMS4.2.3.2 Control of External Documents.

5.2   Review of identified Documents

All Legal and other document reviews are to be conducted utilising the DataWeb legislative compliance tool 

The following steps are to be taken when undertaking when conducting an assessment.

Step 1

Select the legal or other document from the drop down list.

Step 2

If the required document is not listed in the drop down box, this indicates that it has not yet been reviewed. Go to the Top of the page and enter the details of the document being reviewed and click "Add Legislation".

Step 3

Once the Document has been added it will appear in the Drop Down Box. Find the and click on the document. 

Step 4

Once the document has been selected the state and location of operations in the state need to be selected from the Drop Down Boxes.

When you select a state the current location sof operations in that state will appear for selection.

Step 5

Enter the Following Details at the top of the section

  • Date of Review
  • Date of change notification (if Applicable)
  • Select who is conducting the Review

Review the legal or other document and identify each section that has an impact on the company. Copy a reference to the section and describe its impact on the company 

Step 6

Select one company document that directly addresses the legal or other requirement.

If there is no document that directly address the requirement. The reviewer is to raise a corrective action (CAR) to have the requirement assessed by the HSEQ Manager

Step 7

Identify any documents that have relevance to the Legal or other requirement

Step 8

Once all section have been completed the review adds their unique code and presses the "Add Legislation Assessment" Button.

This will add the completed review to the Database..

5.3 Periodic Review

Periodic review are to conducted in accordance with section 5.2 of this procedure with the exemption in Step 2

5.4   Monitoring of Documents

The HSEQ Manager will acquire and manage the currency of external documents relevant to the company’s operations. The HSEQ Manager will maintain a register of relevant external documents which will be reviewed on a annual basis and as required to maintain currency. This will be conducted using the following techniques.

  • Subscription to Legislation updates through the Office of the Queensland Parliamentary Counsel

  • Subscription to Standards Australia Email updates

  • Subscription to Workplace Enviro Australia Pty Ltd

  • Subscription to Workplace Safety Australia Pty Ltd

Any Company employee who recognises a need or benefit in acquiring a document is encouraged to do so by requesting the HSEQ Manager to arrange for the document to be procured; or where appropriate, to acquire the document and deliver it to the HSEQ Manager for registration and issue.
